Real Estate Law and Property Transfers for Inverness and Citrus County Families

Protect Your Home and Land with an Estate Planning Attorney Who Knows Florida Property

Your home is often your largest asset, and how it is titled decides who controls it, who inherits it, and whether it passes through probate.

How Real Estate Law Shapes Your Estate Plan

Real estate is the piece of an estate that most often causes trouble. A house, a few acres near Lake Tsala Apopka, or a rental property can become a long court matter if the title is not handled correctly. At Eden Law Group, P.A. in Inverness, FL, we help clients connect their property to a complete estate plan.

Attorney John H. Eden IV has practiced in estate planning and administration for over 20 years. He is licensed in Florida and Montana, so he understands the issues that come up when a family owns land in more than one state.

Florida law looks at how property is titled at your death, not at what you meant to happen. A home held in your sole name must be probated, even if you have a will. The right deed, prepared in advance, can change that outcome.

Key Real Estate Issues We Help You Address

Most real estate questions we see are tied to estate planning. Sorting them out early saves your family time and expense later. These are the topics clients raise most often:

Transferring your home into a revocable living trust so it avoids probate administration at your death.
Quit claim deeds that move property into your trust, prepared and recorded correctly in the county where the property sits.
Out-of-state property, such as a summer home, which can trigger a second (ancillary) probate proceeding.
Joint ownership problems, including exposure to a co-owner's liabilities and possible loss of Florida constitutional homestead protection from creditors.
Property owned by a spouse or child and the tax or control issues that come with adding names to a deed.
Planning for incapacity, so a durable power of attorney and trust provisions let someone manage your property without a court-appointed guardian.

Why Trust Funding and Deeds Matter

A revocable living trust protects your family only if your assets are in it, which is called trust funding. A trust that never receives the deed to your home will not keep that home out of probate. Our asset transfers into trusts follow this process:

1. We review your current deeds, titles, and accounts during your estate planning consultation.
2. We draft your trust, pour-over will, durable power of attorney, and health care surrogate designation.
3. We prepare quit claim deeds for each property you want to place in the trust.
4. We record each deed with the proper county clerk, in Florida or in another state.
5. We can refer you to a qualified financial advisor, at no added charge, for help funding other accounts.
Our fee for an in-state quit claim deed is approximately $250 per deed and property, and an out-of-state deed is approximately $500. Recording fees up to $25 are included. Fees are estimates and depend on your needs.

Benefits of Planning Your Property the Right Way

Careful planning lets you keep control of your property while you are alive and makes things easier for the people you leave behind. Families in Inverness, Hernando, and Marion County often tell us that knowing the house is settled brings real peace of mind.
